Don’t think it’s no big deal if you commit a probation violation. The ramifications can b serious, according to Chris Kopecky. As lead counsel of The Traffic Lawyers, P.A., based in Oberland Park, Kansas, he gives advice to people who violate their parole or probation practically every day. Read on to see what can be done, with the advice of a good lawyer.
Probation violations and parole violations are potentially serious. The way that a probation violation works is that you are accused as a defendant of violating your probation in some manner by the probation officer. You have the opportunity to contest that violation, and argue that it never really happened. Or alternatively you may stipulate that it did in fact happen, but with an explanation of why.
Depending upon whether or not the violation will be contested may have a significant impact on the result. We have different strategies, depending upon the court and the type of violation, as compared to the original charge, that we have found to be effective.
Every Court is Different
There are some courts where it is never to our advantage to stipulate the probation violation, as we know the judge will likely put the defendant in jail and impose a sentence of the original charge. This can be devastating for someone who has been on probation for many months without incident, and suddenly finds himself in a difficult situation because he inadvertently failed to report to the probation officer.
Minor violations of probation are far easier to deal with than direct violations that are consistent with the original charge. But with both cases, the important thing to keep in mind is to resolve your criminal matter as soon as possible. Violations can affect your insurance, your ability to drive, or could put you in jail.
