Intellectual Property and Businesses

Tom Jurgensen | February 1, 2010

Entrepreneurial and business leader Tom Jurgensen is also managing shareholder of the Catalyst Law Group APC, a technology-focused law firm that is headquartered in San Diego. Here, he talks about why intellectual property is so crucial to whether or not a business succeeds, and who you should contact to protect it.

I work with a lot of start-up businesses, and for a young business getting started, intellectual property often is critical. If they are going to raise money to fund their business, one of the things most investors want to know is, do you have intellectual property protection on your product, or service, or name, or whatever it is.

That’s important to people who want to borrow money or invest in a company. They look seriously at the intellectual property. They do not just see whether you have it; they analyze it to see if it is any good or not in order to be honest with you.

Business Strategy

So that should be vital to the business strategy of any firm. Many companies need that intellectual property to grow and to protect themselves. Think about a small company that has a new product that is patented. If they do not have a patent, a big company can come along, make a product that is similar, and steal the market from them.

That happens a lot if a company does not have a patent to stop the other company from doing that. When you go to large companies or big corporations, they have hundreds of millions if not more in their intellectual property. It is important to them. It is how they build up their success and keep their place in the marketplace. And they have built that over time.
